Single-User Online Video Course Terms & Conditions of Use

We don’t like the pages and pages of terms and conditions full of legal jargon that you see for most online products these days. We’ve tried hard to keep these
terms and conditions simple and understandable.

Single, one-time payment

• When you purchase access to a video course you will make a single one-time payment.
• We don’t auto-renew memberships. If you want to continue your membership after one year you will need to manually pay again.
• We do not retain your credit card details on our system.

Quick Summary of what you are buying

• During the twelve months of your membership you will have online access to view, use, and display the Content an unlimited number of times, solely
  through a web browser and solely for your personal, non-commercial use.
• You will be able to download and make use of  any relevant sample files for as long as they are present on the TheSmartMethod.com website. You will be able to download the sample files as many times as you want to.

Our promise to you

• We’ll behave ethically and correctly at all times and always do what we believe to be the “right thing” to resolve any query or dispute. Our ethos is
  to ensure 100% customer satisfaction.
• We will not store your credit card details (yes, we already said that but it’s so important that it is worth saying a second time).
• We will not, under any circumstances whatsoever give out or sell your information (including name and email address) to anyone.
• We will never send you an email unless it is directly related to your purchase.

Your promise to us

• You are buying a license to use the online video course for your own personal use. You promise that you will not share your access to the videos and associated materials with anybody else.
• You are buying a license to view the video course online. You promise that you will not attempt to download any video content for use offline.

Smart Method Enterprises Ltd – TheSmartMethod.com website

This is an agreement between you and The Smart Method Ltd. By purchasing or using any video Content or Service, you agree to be bound by the terms of this agreement. If you do not accept the terms of this Agreement, then you may not use any video Content or Service.

For the purposes of the Agreement

• “Content Provider” means the Smart Method Ltd.
• “Licensor” means the Smart Method Ltd.
• “Service” means the provision of any other services that we provide video course purchasers with.
• “Content” means digitised content contained within a video course.

What we promise to do

• We will not store your credit card details.

• We will never send you an email unless it is directly related to your subscription.

Use of video course Content

Upon your payment and subsequent access to the video course content, the Content Provider grants you a non-exclusive right to view, use, and display the Content an unlimited number of times, solely through a web browser and solely for your personal, non-commercial use.

The video course is licensed, not sold, to you by the Content Provider. The Content Provider may include additional terms of use within the Content. Those terms will also apply, but this Agreement will govern in the event of a conflict.

What you are allowed to do

You are granted a non-transferable single-user license to:

• View the course(s) purchased online, on any number of devices (such as your PC, iPad or telephone) and in any location (such as at work, at home, on a train or in a coffee shop). If you want to watch a lesson at home, another on the train on the way to work, another on your work PC, and another using the coffee shop WiFi at lunchtime that’s perfectly OK.
• Download and make use of the sample files. You can download them as many times as you want to.

What you are NOT allowed to do

• Capture, download or save any of the videos you view from the web site.
• Remove copyright notices from any materials obtained from the web site.
• Allow other users access to the videos or e-books by sharing your username and password. Please be careful not to allow others to discover your user name and password. You have purchased a single-user license and may not allow others to use your account. Our servers automatically detect and report many forms of password sharing fraud. Contact us if you need a multi-user license (for example for a school or corporation) as we have multi-user educational/corporate plans available. We’ll send you an information pack by return e-mail.
• Unless specifically indicated otherwise, you may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to the Content or any portion of it to any third party, and you may not remove or modify any proprietary notices or labels contained within the Content.

Cancellation and Refunds

No fees paid for the use of video course Content or Service are refundable.

Limited Warranty

We test our site using Android, iPad, Apple PC and Windows PC devices running the latest unmodified versions of Internet Explorer, Chrome, Firefox and Safari browsers. While we make every effort to maintain compatibility with these devices, we provide no warranty that your hardware will be compatible, or Internet connection will be sufficient, to access the training materials. The training materials are provided on an “as is” basis without warranty of any kind, express or implied, including (but not limited to) any implied warranties of merchantability and/or fitness for a particular purpose. The Licensor does not warrant that the tutorials will meet any specific requirement or are free from errors.

Limitation of remedies

The Licensor’s entire liability under any provision of this license agreement shall never exceed the price paid for the membership. In no event will the Licensor
be liable to you for any damages, including without limitation, loss of business, revenue, profits, goodwill or other consequential damages arising out of the use, or inability to access, the training materials.

Changes to Service and Amendments

We may change, suspend, or discontinue the Service, in whole or in part, including adding or removing Content from a Service, at any time without notice. We may amend any of this Agreement’s terms at our sole discretion by posting the revised terms on the TheSmartMethod.com website. You will be subject to the terms of the Agreement in force at the time that you use the Software or Service.

Disclaimers and limitation of liability

We take great pains to attempt to ensure 100% up-time of our servers and that our site content is error and virus free. However, it is impossible to guarantee
100% up-time and even the world’s largest sites have been known to have occasional down-time. We do not warrant that your access to the site will be uninterrupted, error free, virus free or completely secure but we will extend our best efforts in making it so. Under no circumstances will The Smart Method Ltd be liable to any compensation for damages of any description caused by site down-time or any consequences of using the website.

Copyright

The Smart Method Ltd retains copyright and all intellectual property for all materials published on the site. Nothing you read or see on the site may be copied, modified, distributed, transmitted, republished, displayed or performed for commercial use, without the prior written agreement of a director of The Smart Method Ltd.

Governing law

This agreement shall be governed by the laws of the Isle of Man, Great Britain.

If any provision of this agreement is for any reason found to be unenforceable, the remainder of this agreement will continue in full force and effect.
